These Terms of Use ("Terms") govern your access to and use of AISmartContent's AI-assisted content creation, social media management, publishing, analytics, and related services at socialpost.aismartcontent.co (the "Service"). By using the Service, you agree to these Terms and our Privacy Policy.
1. Eligibility and accounts
You must be legally able to enter into these Terms and meet the minimum age required in your jurisdiction. You must provide accurate account information, safeguard your credentials, and promptly notify us of suspected unauthorized access. You are responsible for activity performed through your account and workspace.
2. Google Sign-In and connected services
Google Sign-In is used only to authenticate you with the basic openid, email, and profile permissions. Optional Google services, including YouTube or Google Drive features, require a separate connection and the permissions displayed by Google for that feature. You decide whether to grant those permissions and may revoke them through AISmartContent or your Google Account Connections page.
You authorize AISmartContent to access a connected service only as needed to perform actions you request. You remain responsible for your third-party accounts, their content, and compliance with their terms and policies. Availability of a third-party integration may change when that provider changes or withdraws access.
3. Acceptable use
You may not use the Service to violate law or third-party rights; access accounts or systems without authorization; distribute malware or deceptive content; facilitate abuse, harassment, exploitation, or fraud; evade platform safeguards; interfere with Service operation; scrape or reverse engineer protected portions of the Service except where law permits; or submit content you do not have the right to use.
4. Your content and instructions
You retain ownership of content you submit. You grant us a limited license to host, process, reproduce, and transmit that content only as needed to operate the Service, perform your publishing instructions, secure the Service, and comply with law. You represent that you have the rights and permissions needed for your content and connected accounts.
AI-generated output may be inaccurate, incomplete, or similar to output provided to others. You must review output before use or publication and are responsible for your final content, claims, disclosures, and platform compliance.
5. Privacy, retention, and deletion
Our Privacy Policy explains how we collect, use, share, retain, and delete information, including Google user data. It also explains Google access revocation, account deletion, the 30-day active-system deletion target, and limited backup or legal retention.
You may disconnect integrations, delete available content, or request account deletion. Disconnecting an integration stops future authorized access after credential invalidation but does not delete your entire AISmartContent account. Account deletion requests may be submitted through signed-in profile settings or to [email protected].
6. Plans, billing, and availability
Paid plans, usage limits, credits, renewals, refunds, and taxes are described at purchase and may be subject to additional billing terms. Except where law requires otherwise, fees already incurred are non-refundable. We may change or discontinue features, integrations, or limits, but will provide notice of material changes when reasonably possible.
7. Suspension and termination
You may stop using the Service at any time. We may limit, suspend, or terminate access when reasonably necessary to address violations, nonpayment, legal requirements, security risks, abuse, or harm to users or third parties. Sections that by their nature should survive termination remain effective, including ownership, payment obligations, disclaimers, liability limits, and dispute terms.
8. Intellectual property
The Service, software, interface, trademarks, and documentation are owned by AISmartContent or its licensors. Except for the limited right to use the Service under these Terms, no rights are transferred to you.
9. Disclaimers and limitation of liability
To the maximum extent permitted by law, the Service is provided "as is" and "as available" without warranties of uninterrupted operation, error-free output, fitness for a particular purpose, or continued third-party integration availability. AISmartContent is not responsible for decisions made solely from AI output or for actions taken by a connected platform.
To the maximum extent permitted by law, AISmartContent will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or loss of profits, data, goodwill, or business opportunity. Any aggregate liability will not exceed the amount you paid for the Service during the 12 months before the event giving rise to the claim. Applicable law may provide rights that cannot be limited.
10. Changes and contact
We may update these Terms as the Service or law changes. We will publish the revised Terms and update the effective date. Continued use after the effective date constitutes acceptance where permitted by law.
